1. Acceptance of Terms
By downloading, installing, or using the TapOkie mobile application or any related services ("Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Services. We may update these Terms from time to time; continued use after changes constitutes acceptance. For material changes, we may notify you in the app or by email.
2. Eligibility
TapOkie is intended for users aged 13 and older. You must be at least 13 years of age to use the Services. If you are under 13, you should have your parent or guardian's permission to use the app. By using TapOkie, you represent that you meet these requirements and that all information you provide is accurate and current.
3. Description of the Service
TapOkie is a wellness and safety check-in application that allows you to:
- Perform daily check-ins (e.g. tap "I'm OK") within a chosen time window.
- Add emergency contacts who may receive SMS alerts (and optionally your last known location) if you miss a check-in or use the emergency button.
- Receive reminders and manage your check-in schedule, skip dates, and pause settings.
- Use a one-tap emergency button to notify your contacts immediately when you need support.
TapOkie is designed to help you stay connected with people who care about you. It is not a substitute for emergency services, medical care, or professional help.
4. Important Disclaimer – Not Emergency Services
In a life-threatening or medical emergency, call your local emergency number (e.g. 911 in the United States) immediately. TapOkie does not contact emergency services, police, or ambulance. The emergency button and missed-check-in alerts notify only the contacts you have added to your account. We do not guarantee that your contacts will see or act on alerts, or that help will arrive. You are responsible for ensuring that your contacts understand their role and that you have a plan for real emergencies.
The Services are provided for peace of mind and connection only. We are not liable for any failure of you or your contacts to respond, or for any delay or lack of response by emergency or other third-party services.
5. Account and Use
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to:
- Provide accurate registration and profile information and keep it up to date.
- Use the Services only in compliance with these Terms and applicable law.
- Not misuse the Services (e.g. harassment, false alerts, impersonation, or abuse of contacts).
- Ensure that you have consent from any emergency contacts you add before adding them and that they agree to receive alerts.
We may suspend or terminate your account if we reasonably believe you have violated these Terms or for other operational or legal reasons.
6. Service Limits and Auto-Pause
The following limits and behaviors apply to the Services:
- Emergency button: You may use the one-tap emergency button to notify your contacts up to five (5) successful emergency taps per calendar month. Additional emergency taps in the same month will not trigger further notifications to your contacts until the next month.
- Auto-pause after missed check-ins: If you do not check in for three (3) consecutive days, we will automatically pause your check-ins to reduce unnecessary alerts to your contacts. Check-ins will remain paused until you turn them back on in the app. You are responsible for re-enabling check-ins when you are ready to resume.
7. Subscriptions and Payments (Premium)
Premium is available as monthly or annual subscriptions. Subscriptions auto-renew at the end of each period (month or year) unless you cancel before the period ends. Payment is charged to your Apple or Google account at confirmation and at each renewal.
Cancellation: You cannot cancel or change your subscription from within the TapOkie app. To cancel, turn off auto-renewal or manage your subscription through your device settings or your app store account (Apple App Store or Google Play). After you cancel, you will keep Premium access until the end of the current billing period; no refund is given for the unused portion. Refunds are otherwise subject to the app store's policies.
We may change Premium features or pricing with notice; continued use after the change constitutes acceptance.
8. Intellectual Property
TapOkie and its content, features, and functionality (including but not limited to software, design, text, and graphics) are owned by us or our licensors and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Services or content without our prior written permission. You may use the app only for your personal, non-commercial use in accordance with these Terms.
9. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or secure. We do not guarantee that your contacts will receive or act on alerts. Use of the Services is at your own risk.
10. Limitation of Liability
To the maximum extent permitted by applicable law, TapOkie and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the Services. Our total liability for any claims arising from or related to the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or, if you have not paid, one hundred U.S. dollars). Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless TapOkie and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any third-party rights.
12. Termination
You may delete your account at any time from within the app. When you delete your account, we delete all personal data (PII) we hold associated with it, as described in our Privacy Policy. We may suspend or terminate your account or access to the Services at any time for breach of these Terms or for other reasons. Upon termination, your right to use the Services ceases. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and governing law) will survive termination.
13. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which TapOkie operates, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved in the courts of that jurisdiction, and you consent to the personal jurisdiction of such courts. If you are in the European Union, you may also have the right to bring a claim in your country of residence.
14. General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms constitute the entire agreement between you and TapOkie regarding the Services and supersede any prior agreements.
